Description

Marc Spencer Young appeals his conviction for residential burglary. He contends that the trial court erred in denying his motion to suppress evidence, arguing the officers lacked probable cause to arrest him. Young was found two blocks from the crime scene six minutes after the burglary occurred. The suspect was described as a black male, and Young was the only black male seen in the area. His clothing matched the description given by the victims except for his shirt. And while the weather was very cold and rainy, Young was wearing only a t-shirt, which was dry. All these facts gave the officers probable cause to believe Young had committed the burglary. The arrest was therefore lawful, and the evidence obtained pursuant to the arrest was properly admitted. We affirm.
